The Covenants Committee is pleased and proud to announce the launch of our new communication program called “Covenants Corner”. This program is designed to increase transparency and awareness about the governing documents that support and guide our community standards. In this inaugural newsletter, we explain the role of the Covenants Committee.

Briar Chapel is a wonderful community with 4,000 residents and over 2,000 homes. All of us are members of the Homeowners Association (HOA). Together, we pay dues, manage our community, and agree to abide by the many governing documents: Covenants, Conditions, and Restrictions (CC&Rs), By Laws, Rules and Regulations, Amendments, Design Review Guidelines, and Articles of Incorporation. The rules are established and enforced to protect, enhance, and maintain homes while upholding the community’s value and appeal.

The role of the Covenants Committee is two-fold and is detailed in the committee’s charter. One role is adjudicatory. That means we serve as a hearing committee when homeowners have allegedly violated the governing documents and have not sufficiently resolved the violation with the Management Company. The other role is advisory. That means we periodically offer recommendations to the Board regarding issues dealing with the governing documents. The committee does not establish the rules of the community (this is the purview of the Board of Directors, which has a limited ability to make or change rules in accordance with the governing documents), nor does the committee monitor for or cite violations (this is the purview of the management company).

Through “Covenants Corner”, we hope to help everyone better understand the details of the covenants, the architectural design and landscape requirements, and the entire process of everyone’s accountabilities as homeowners. On this committee, we are volunteers and your neighbors, dedicated to serving all homeowners for the benefit of the community.
